1. Acceptance of Terms

By accessing or using the Massage Finder website at https://www.massage-finder.co.za/ (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms constitute a binding agreement between you and Massage Finder ("we", "us", "our") in terms of the Electronic Communications and Transactions Act 25 of 2002 (ECT Act).

2. Description of the Platform

Massage Finder is an online directory that connects members of the public ("Visitors") with independent massage therapists and related service providers ("Massage Therapists") in South Africa. We do not employ, endorse, or certify any Massage Therapist listed on the Platform. We merely provide the directory platform.

3. Registration and Accounts

3.1 To list your services as a Massage Therapist, you must register for an account by providing accurate, complete and current information.

3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.3 You must notify us immediately of any unauthorised use of your account.

3.4 We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for unlawful purposes.

3.5 You must be at least 18 years of age to register on the Platform.

4. Massage Therapist Profiles and Content

4.1 You are solely responsible for all content you submit to the Platform, including profile information, photographs, and service descriptions.

4.2 By submitting content, you warrant that:

• The information is accurate, truthful and not misleading;
• You hold all necessary qualifications, registrations or licences required by South African law to offer the services described;
• The content does not infringe the intellectual property rights of any third party;
• The content is not unlawful, defamatory, obscene or offensive.

4.3 We reserve the right to remove or edit any content that, in our sole discretion, violates these Terms or applicable law.

5. Prohibited Conduct

You agree not to use the Platform to:

• Post false, misleading or fraudulent information;
• Advertise or facilitate any illegal services;
• Harass, threaten or harm other users;
• Attempt to gain unauthorised access to any part of the Platform;
• Use automated tools to scrape, crawl or extract data from the Platform without our written consent;
• Violate any applicable South African law or regulation.

6. Disclaimer of Warranties

6.1 The Platform is provided on an "as is" and "as available" basis without any warranty of any kind, whether express or implied.

6.2 We do not verify the qualifications, certifications, licensing or identity of any Massage Therapist listed on the Platform. Visitors are responsible for conducting their own due diligence before engaging any service provider.

6.3 We do not guarantee the accuracy, completeness or currency of any information provided by Massage Therapists on the Platform.

7. Limitation of Liability

7.1 To the maximum extent permitted by applicable South African law, Massage Finder shall not be liable for any direct, indirect, incidental, special or consequential damages arising from:

• Your use of or inability to use the Platform;
• Any services obtained from or through a Massage Therapist listed on the Platform;
• Unauthorised access to or alteration of your data;
• Any other matter relating to the Platform.

7.2 Nothing in these Terms limits our liability for death or personal injury caused by our gross negligence, or for fraud, as these cannot be excluded under South African law.

8. Intellectual Property

8.1 All intellectual property rights in the Platform, including its design, software, logos, text and graphics, are owned by or licensed to Massage Finder.

8.2 You may not reproduce, distribute, modify or create derivative works of any content from the Platform without our prior written consent.

8.3 By uploading content to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content solely for the purpose of operating the Platform.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

10. Links to Third-Party Websites

The Platform may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. Amendments

We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the Platform after the posting of amended Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to your rights under the Consumer Protection Act 68 of 2008.

13. Dispute Resolution

13.1 In the event of a dispute, you agree to first attempt to resolve the matter directly with us by contacting info@massage-finder.co.za.

13.2 If the dispute cannot be resolved informally, either party may refer the matter to mediation or, failing that, to the appropriate South African court.

13.3 Where applicable, disputes may also be referred to the National Consumer Commission in terms of the Consumer Protection Act 68 of 2008.

14. Consumer Protection Act

Nothing in these Terms is intended to limit or exclude any rights you may have under the Consumer Protection Act 68 of 2008. Where any provision of these Terms conflicts with the CPA, the CPA shall prevail to the extent of such conflict.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Massage Finder with respect to your use of the Platform and supersede all prior agreements and understandings.
